TERMS & CONDITIONS

1. Acceptance of Terms

By accessing, using, booking, reserving, or making any payment to Travel Vistaa (“Company”), the Client acknowledges that they have read, understood, and agreed to be legally bound by these Terms & Conditions, Cancellation Policy, Refund Policy, and all other policies published by Travel Vistaa.

Any payment made to Travel Vistaa shall constitute unconditional acceptance of these Terms & Conditions.

2. Booking & Confirmation

* All bookings are subject to availability and confirmation.
* A booking shall be considered confirmed only upon receipt of the required booking amount and written confirmation from Travel Vistaa.
* Travel Vistaa reserves the right to refuse, suspend, modify, or cancel any booking due to operational, supplier-related, commercial, legal, safety, or other circumstances beyond its reasonable control.
* Prices and quotations are subject to change until the booking is confirmed.

3. Booking Amount Policy

* The booking amount paid by the Client is non-refundable once the booking process has been initiated by Travel Vistaa.
* If Travel Vistaa is unable to confirm the requested package, hotel, villa, resort, transportation, or travel service due to non-availability or operational reasons, the booking amount may be refunded after deduction of 20% of the booking amount towards service charges, consultation fees, administrative expenses, and processing costs.
* No refund shall be applicable if the Client voluntarily cancels the booking, changes travel plans, fails to provide required documents, fails to make payments within the prescribed timelines, or decides not to proceed after confirmation.

4. Package Cancellation Policy

Domestic Tours

* Cancellation made 45 days or more before departure: 25%–30% cancellation charges.
* Cancellation made between 30 and 15 days before departure: 50% cancellation charges.
* Cancellation made within 15 days before departure or No Show: 100% cancellation charges.

International Tours

* Cancellation made 45 days or more before departure: 25%–30% cancellation charges.
* Cancellation made between 30 and 15 days before departure: 50% cancellation charges.
* Cancellation made within 15 days before departure or No Show: 100% cancellation charges.

No refund shall be payable for any unused services after commencement of travel.

5. Package, Hotel & Property Modification Policy

* Clients may request modifications to hotels, resorts, villas, accommodations, or travel packages up to 60 days before travel, subject to availability.
* Travel Vistaa shall make reasonable efforts to accommodate such requests.
* If the revised property or package costs more than the original booking, the Client shall pay:
* The full difference in package cost; and
* An additional modification and administrative fee of ₹5,000.
* Any additional taxes, supplier charges, transportation charges, transfer charges, hotel charges, or related expenses arising from such modifications shall be borne solely by the Client.

6. Transfers & Transportation

Travel Vistaa reserves the right to modify, substitute, reschedule, upgrade, downgrade, or change transportation arrangements, transfer services, pickup timings, routes, vehicles, airlines, carriers, transportation modes, or related services at any time due to operational requirements, supplier limitations, safety concerns, weather conditions, government regulations, force majeure events, or circumstances beyond the Company’s control.

Such modifications shall not automatically entitle the Client to refunds, compensation, or cancellation rights.

7. Visa Services Disclaimer

Travel Vistaa acts solely as a facilitator for visa-related services and documentation.

Travel Vistaa does not guarantee:

* Visa approval;
* Visa issuance;
* Processing timelines;
* Immigration clearance;
* Entry permission;
* Border clearance.

All decisions relating to visas and immigration are made exclusively by the relevant embassies, consulates, immigration authorities, and government agencies.

Visa Rejection, Delay & Non-Refundable Charges

In the event of:

* Visa rejection;
* Visa delay;
* Administrative processing;
* Government restrictions;
* Additional document requirements;
* Embassy decisions;
* Immigration decisions;
* Force majeure events;

Travel Vistaa reserves the right to retain amounts paid towards service charges, supplier payments, documentation expenses, administrative costs, operational expenditures, and processing fees.

Any refund, if considered, shall be subject to supplier policies, actual expenses incurred, and the Company’s review of the matter.

8. Refund Policy

All refunds shall be subject to the cancellation policies, refund policies, approvals, and processing timelines of the respective third-party suppliers, including airlines, hotels, resorts, villas, transportation providers, destination management companies, cruise operators, visa authorities, embassies, and other service providers.

Travel Vistaa acts solely as an intermediary and shall not be responsible for delays caused by third-party suppliers, banks, payment gateways, government authorities, or service providers.

Refund Processing Timeline

* Approved refunds may require 45–60 working days for processing.
* Where refunds are pending from third-party suppliers, the processing timeline may be extended.
* The Client acknowledges and agrees that Travel Vistaa may require up to 180 days (6 months) or longer, where necessary, to receive supplier settlements and complete the refund process.

Refund Deductions

The following may be deducted from refundable amounts:

* Service charges;
* Consultation fees;
* Administrative charges;
* Processing fees;
* Booking charges;
* Bank charges;
* Payment gateway fees;
* Currency conversion charges;
* Supplier penalties;
* Government fees;
* Documentation expenses;
* Taxes and statutory deductions;
* Any other costs incurred in connection with the booking.

The final refundable amount, if any, shall be determined after accounting for all applicable deductions and supplier charges.

9. Force Majeure

Travel Vistaa shall not be liable for any delay, cancellation, interruption, modification, loss, or failure in providing services resulting from events beyond its reasonable control, including but not limited to:

* Natural disasters;
* Floods;
* Earthquakes;
* Storms;
* Pandemics;
* Epidemics;
* Government restrictions;
* Political unrest;
* Civil disturbances;
* Strikes;
* War;
* Terrorist activities;
* Airline disruptions;
* Transportation failures;
* Border closures;
* Weather conditions;
* Acts of God.

In such situations, Travel Vistaa shall first assess the circumstances, supplier policies, operational feasibility, and financial impact before determining whether any rescheduling, travel credit, voucher, adjustment, or refund may be offered.

No automatic refund shall be due solely because a Force Majeure event has occurred.

10. Client Responsibilities

The Client is solely responsible for:

* Providing accurate information and documentation;
* Holding valid passports, visas, permits, and travel documents;
* Complying with immigration requirements and local laws;
* Reporting on time for flights, transfers, and scheduled activities;
* Making payments within stipulated deadlines.

Travel Vistaa shall not be responsible for losses arising from incomplete documentation, denied boarding, denied entry, inaccurate information, missed departures, or Client negligence.

11. Limitation of Liability

Travel Vistaa acts as an intermediary between Clients and third-party suppliers.

Travel Vistaa shall not be liable for:

* Airline delays or cancellations;
* Hotel overbookings;
* Supplier defaults;
* Visa rejections;
* Immigration decisions;
* Transportation disruptions;
* Loss of baggage;
* Theft;
* Personal injury;
* Accidents;
* Consequential, indirect, incidental, special, or punitive damages.

To the maximum extent permitted by applicable law, Travel Vistaa’s liability shall be limited to the service fees retained by the Company in relation to the relevant booking.

12. Client Conduct

Clients shall not engage in:

* Fraudulent activities;
* Payment fraud;
* Chargeback abuse;
* False complaints;
* Harassment;
* Threats;
* Blackmail;
* Extortion;
* Publication of knowingly false, misleading, malicious, or defamatory statements.

Travel Vistaa reserves the right to suspend services, cancel bookings, deny future services, recover losses, and pursue legal remedies available under applicable law.

13. Dispute Resolution & Prior Notice

Any complaint, dispute, refund request, legal claim, demand, or grievance must first be submitted to Travel Vistaa in writing.

The Client agrees to provide Travel Vistaa with a minimum written notice period of 90 days (3 months) before initiating any legal proceedings, arbitration, recovery action, or formal dispute against the Company.

During this notice period, Travel Vistaa shall be entitled to investigate the matter, review records, communicate with suppliers, and attempt an amicable resolution.

14. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of India.

Any dispute arising out of or relating to Travel Vistaa, its services, bookings, payments, cancellations, refunds, visa assistance, or related matters shall be subject to the exclusive jurisdiction of the competent courts located in Delhi, India.

15. Amendments

Travel Vistaa reserves the right to amend, modify, update, revise, or replace these Terms & Conditions at any time without prior notice.

The latest version published on the Company’s website shall prevail.
